We are seeking

Bitdeer (NASDAQ: BTDR) is looking for a senior litigator for our U.S. Legal team in San Jose, California as Director, Legal Affairs (Litigation). Bitdeer builds and operates data center and power infrastructure across multiple U.S. states, and the disputes that come with it span commercial, construction and energy contract claims, insurance coverage and subrogation, securities, employment, bankruptcy, and land use and regulatory matters.

This is a function leadership role. You will define litigation strategy: which matters we fight and which we resolve, who we hire to fight them and on what terms, how we preserve evidence, and what management, Finance and our auditors are told about exposure. You will work as a senior litigation voice alongside experienced litigation counsel already handling matters. The role reports to the General Counsel, North America.

What you will be responsible for

  • Manage a North America disputes docket end to end — allocate matters, set strategy, and hold accountability for outcome, timeline and spend across every active litigation, arbitration, pre-suit dispute and adversarial regulatory proceeding.
  • Lead high-exposure matters, including litigation bearing on major sites and projects, securities and shareholder matters, and anything carrying public-company disclosure consequences.
  • Build and manage the outside counsel panel: select firms, negotiate rates and alternative fee arrangements, set staffing and budget expectations, and report spend and performance by matter and by firm.
  • Manage the litigation hold and preservation program across the North America function — issuance and scope, custodian tracking, eDiscovery vendor management, privilege and production oversight, and training business teams on their obligations.
  • Set the standards the litigation function runs on: matter intake and early case assessment, case management and budgeting, status reporting cadence, and escalation and settlement authority thresholds.
  • Provide exposure, reserve and loss-contingency analysis to Finance, auditors and the public-company disclosure process, and present litigation status and risk to senior management and, as requested, to the Board or Audit Committee.
  • Recommend settlement positions grounded in litigation risk, cost to continue and commercial consequence, and negotiate resolutions directly where that is the faster path.
  • Lead responses to subpoenas, regulatory inquiries and government information requests, and conduct or oversee internal investigations.
  • Act as the senior litigation voice alongside experienced litigation counsel on the team — setting strategy on significant matters, reviewing key work product, and developing their practice — without displacing their ownership of the matters they run.
  • Partner with project, construction, energy, procurement, HR and finance teams to identify dispute risk early, improve contract terms and operating practices, and reduce the volume of disputes over time.
  • Manage insurance claims and coverage disputes, and advise the business on the adequacy of Bitdeer's own coverage program.
  • Support management on other legal matters as assigned.

How you will stand out

  • J.D. from an ABA-accredited law school and active bar membership in good standing. California admission is preferred; attorneys admitted in another U.S. jurisdiction should be eligible to register as Registered In-House Counsel in California.
  • 12+ years of complex commercial litigation experience at a leading law firm and/or as in-house litigation counsel, including time as the senior-most litigation lawyer in a function, a practice group leader, or the lead partner on a portfolio of matters for a major client.
  • A record of owning matters end to end in state and federal court and in arbitration — dispositive motion practice, discovery and expert work, and first- or second-chair trial or arbitration hearing experience.
  • Demonstrated ownership of outside counsel economics: panel selection, rate and fee negotiation, budget discipline, and the judgment to recognize when a matter is being over-staffed.
  • Experience advising executives and boards on exposure, reserves and resolution, with the credibility to be believed when you recommend fighting or settling.
  • Experience building litigation infrastructure — preservation programs, matter intake, reporting, authority thresholds — in a function that did not previously have it.
  • The judgment to set standards and influence colleagues' work without relying on reporting lines, and the willingness to stay hands-on while doing it.
  • Excellent writing and oral advocacy skills.
  • High self-motivation and a collaborative style suited to a fast-growing, global company.
  • Ability to work with colleagues across Asia and North America, including some meetings outside U.S. business hours, and to travel to project sites, courts and hearings as needed.
  • In-house experience at a public company, or disputes experience in energy, power, construction, real estate or infrastructure.
  • Experience with securities litigation, insurance coverage disputes, bankruptcy and creditor disputes, employment litigation, or land use and zoning matters.
  • Internal investigations or regulatory experience, including responses to government inquiries.

What you will experience working with us

  • A culture that values authenticity and diverse perspectives.
  • An inclusive, respectful environment with open workspaces and an energetic, start-up spirit.
  • A fast-growing company with opportunities to network with industry pioneers and enthusiasts.
  • The ability to contribute directly and make an impact on the future of the digital asset and AI computing industry.
  • Involvement in new projects and in developing processes/systems.
  • Personal accountability, autonomy, rapid growth, and learning opportunities.
  • Attractive benefits and development such as training and mentoring.
